Southfork LLC and Resource Recycling LLC v. Social Equity Council

Two Theraplant-affiliated equity joint ventures appealed the Social Equity Council's denial of their EJV retailer applications, saying two sister EJVs with the identical operating agreement were approved. The court dismissed the appeal in April 2024 for lack of jurisdiction.

Docket: HHB-CV23-6080040-S (New Britain).

Status: CLOSED. Judgment of dismissal April 30, 2024 (Judge Budzik).

Parties. Plaintiffs Southfork LLC and Resource Recycling, LLC, both of West Hartford. Defendant the Social Equity Council.

What the appeal says. Four equity joint ventures affiliated with medical producer Theraplant, LLC applied for EJV retailer licenses in May 2022 using the same operating agreement. The council denied Southfork and Resource Recycling for a claimed defect in that agreement but approved the other two, UMN Equity Joint Venture and Transformative Alliances, which went on to receive provisional licenses. Southfork resubmitted in April 2023 and was denied again. The plaintiffs appealed under C.G.S. § 4-183.

What happened. Filed June 28, 2023. The council answered in August 2023 and moved to dismiss in October 2023, arguing the denial of an EJV application is not an appealable final decision under the Uniform Administrative Procedure Act. The plaintiffs opposed; the council replied. On April 30, 2024 Judge Matthew Budzik granted the motion and dismissed the appeal for lack of subject-matter jurisdiction.

Status. Closed. No appeal appears on the docket.
