Docket: NNH-CV24-6149766-S (New Haven).

Status: LIVE on appeal. Judgment for FFDC EJV II February 20, 2026 (SHIV’s appeal dismissed); commission’s reargument denied April 6, 2026; appeal to the Appellate Court filed August 7, 2026.

Parties. Plaintiffs FFDC EJV II LLC (the Fine Fettle equity joint venture that applied for the permit and leases the site) and SHIV, L.L.C. (the property owner). Defendant the North Haven Planning & Zoning Commission.

What the appeal says. The commission denied Fine Fettle’s special permit and site plan application for an adult-use cannabis store at 104 Washington Avenue in the CB-20 zone, citing the lack of a special permit and proximity to a Paul Mitchell school; notice of the denial was published October 17, 2024. The plaintiffs argued the town had neither adopted cannabis regulations nor banned cannabis uses after RERACA and that the denial was unlawful.

What happened. Filed November 20, 2024. The commission answered in June 2025 and filed the certified record in many parts; both sides briefed the case through August 2025. The commission moved to dismiss in November 2025, arguing a jurisdictional defect; the plaintiffs opposed. On February 20, 2026 Judge William Clark issued a memorandum of decision entering judgment for Fine Fettle on its appeal and dismissing SHIV’s appeal. The commission moved to reargue on March 16, 2026; the court denied reargument April 6, 2026 and refused oral argument on it. The commission petitioned for certification April 30, 2026. Fine Fettle moved in June 2026 for an order compelling the commission to comply with the judgment; the court granted a caseflow request and entered orders June 11, 12 and 29, 2026 over the commission’s objections. On August 7, 2026 an appeal to the Appellate Court was filed with all fees paid.
