Docket: HHB-CV24-6084328-S (New Britain).

Status: CLOSED. Judgment by stipulation May 5, 2025.

Parties. Plaintiff C3 EJV I LLC of Newington. Defendant the Social Equity Council.

What the petition says. The council denied C3’s equity joint venture retail application on January 12, 2024. C3 argued the council misread the statutory definition of “disproportionately impacted area” in C.G.S. § 21a-420(20) as revised in June 2023, used DIA zones inconsistently with how it treated other applicants, tried to change the maps through non-binding email guidance, and denied the application without a chance to contest the decision.

What happened. Filed February 8, 2024 and amended May 31, 2024. The council filed the administrative record, part of it under seal, and the parties stipulated to the record in August 2024. After agreed scheduling orders the parties jointly asked for a stay in February 2025. On May 2, 2025 they filed a joint motion for judgment in accordance with an attached stipulated agreement; Judge Budzik granted it May 5, 2025. The stipulation, published here, states among other terms that the delivery business in which C3’s social equity applicant holds a stake will proceed as a non-social-equity delivery business and will pay regular, non-social-equity license fees going forward.
