D&B Wellness, LLC v. Department of Consumer Protection and Commissioner Cafferelli

Danbury dispensary operator D&B Wellness challenged DCP's June 2024 decision to charge it an additional $500,000 license conversion fee. After the court kept the injunction and mandamus counts alive, DCP agreed in March 2026 to rescind the invoice and never collect the fee.

Docket: HHB-CV24-6088609-S (New Britain).

Status: CLOSED. Judgment by stipulation March 20, 2026 (Judge Budzik); DCP rescinded the $500,000 invoice.

Parties. Plaintiff D&B Wellness, LLC, 105 Mill Plain Road, Danbury. Defendants the Department of Consumer Protection and Commissioner Bryan Cafferelli in his official capacity.

What the petition says. On June 21, 2024 DCP determined that D&B owed an additional $500,000 license conversion fee. D&B filed an administrative appeal under C.G.S. § 4-183, asked for a stay, sought an injunction barring collection or any license action tied to the fee, and in the alternative asked for a writ of prohibition or mandamus. The petition recounts that D&B’s equity joint venture application had twice been denied by the Social Equity Council because of administrative errors on the state’s side.

What happened. Filed August 5, 2024. DCP moved to dismiss in October 2024. On April 3, 2025 Judge Matthew Budzik granted the motion as to counts one and two (the administrative appeal) but denied it as to counts three and four, writing that DCP pointed to no authority that the court lacked jurisdiction over requests for injunctions or mandamus. DCP answered in September 2025 and D&B claimed the case for trial. On March 19, 2026 the parties filed a joint motion for entry of a stipulated order, which the court granted March 20, 2026. Under the stipulation DCP rescinds the invoice for the additional $500,000, will not assess or collect it from D&B or its releasees, and will not suspend, revoke or take other adverse action against D&B over the fee.

Status. Closed by stipulated judgment. (The docket still lists a remote pretrial conference for November 9, 2026 and a trial date of December 8, 2026 that were scheduled before the settlement.)
