Docket: AAN-CV24-6058223-S (Milford).

Status: CLOSED. Appeal dismissed by Judge Barry Stevens on October 3, 2025; petition for certification to the Appellate Court denied January 21, 2026.

Parties. Plaintiff PVG LLC d/b/a Rodeo Cannabis Co., a state-licensed cannabis retailer and tenant at 504 Bridgeport Avenue, Shelton. Defendant the Planning & Zoning Commission of the City of Shelton.

What the appeal says. The property sits in Planned Development District #48. Rodeo asked the commission to modify the district’s statement of uses so a cannabis retail store could operate there. The commission said no. Rodeo appealed under C.G.S. § 8-8, arguing the denial was unlawful.

What happened. Filed September 20, 2024. A land-use litigation application was denied in November 2024. The commission returned the administrative record in February 2025 and a revised record in May 2025. Both sides briefed the case in May and June 2025 and stipulated to the facts on aggrievement. On October 3, 2025 Judge Barry Stevens issued a memorandum of decision dismissing the appeal; the decision describes the commission’s view that letting a cannabis store operate was a material change to a basic element of the district that required a full amendment process. Rodeo moved to reargue (denied October 20, 2025) and petitioned the Appellate Court for certification on November 10, 2025. The petition was denied January 21, 2026.

Status. Closed. Judgment for the commission after trial to the court; appellate review refused.
